Class Action Lawsuit Resulting in Charitable Contributions of $300,000

After eight years of litigation, Wites Law Firm, located in Lighthouse Point, Florida, resolved a class action that included charitable contributions totaling $300,000. The lawsuit, which began in Broward County Circuit Court, moved from there to The United States District Court for the Southern District of Florida, The U.S. Court of Appeals for the Eleventh Judicial Circuit Court, and The Florida Supreme Court, before returning to the Broward Circuit Court where the settlement received final approval this year.  Marc Wites ’ argument before The Florida Supreme Court is available on the firm’s website.  Wites Law Firm worked on the case with Robbins Geller Rudman t Dowd LLP.

The case, which was based on violations of the Telephone Consumer Protection Act, for the transmission of unsolicited facsimile advertisements, included a $100,000 charitable contribution to the American Cancer Society, a $100,000 charitable contribution to the American Heart Association, and a $100,000 charitable contribution to the Alzheimer’s Association.
