    MARC’S RECORD-BREAKING

    $3.6M SETTLEMENT IN

    CHILD SEXUAL ABUSE CASE

It all began during the 2004-2005 school year, when a Palm Beach County Elementary School Teacher abused 4 girls in his third-grade class, all of South American decent and from families that had only recently moved to the United States.  The girls are known as the Janie Does.

Unbeknownst to the Janie Does or their parents, this was not the first time the teacher was accused of engaging in such horrific conduct.  Two years earlier, during the 2002-2003 school year, another young – also girl of South American decent and with parents with limited English skills – had the courage to tell her parents that the teacher was abusing her in the same fashion. The next day after telling her parents, they all went to the School to report it.  According to the family, the Vice-Principal, however, refused to believe them. He remained in the classroom and abused the Janie Does 2 years later.

Ultimately, after 11 years of litigation, and on the eve of trial, the School Board relented, and agreed to a record-breaking $3.6 million dollar settlement for the Janie Does. One of the Janie Does explained her experience this way: “Many victims feel like it’s their fault and that they are accountable for what happened to them in some way. I’m here to say that it’s not your fault, and you are not alone. Don’t be afraid to speak up.”

At Wites Law Firm, if we accept your case, it will be on a pure contingency-fee basis: you will not be obligated to pay any attorney’s fees or reimburse us for the costs incurred in your case unless we obtain money for you.

      DR. ANDERSON SEXUAL ASSAULT CASE

Dr. Robert Anderson was a physician at The University of Michigan from 1968 to 2003. He died in 2008. Victims have reported that he sexually assaulted college athletes to whom he was supposed to give physical exams.

According to a press release issued by the University, the sexual abuse claims leveled at Anderson are “disturbing and very serious” and include allegations of unnecessary and inappropriate intimate exams by the doctor of male college athletes over a three-decade period. Since February 2020, more than 100 victims are reported to have contacted the University to tell the stories of their abuse at the hands of Dr. Anderson.

Dr. Anderson’s victims may include former Michigan football and hockey players, wrestlers, and other athletes. The University began investing Dr. Anderson after “after a former student athlete wrote to Athletic Director Warde Manuel in July 2018 to detail abuse during medical exams by Anderson in the early 1970s.” According to the University’s Statement, “during the course of the investigation, detectives interviewed dozens of people and identified several individuals who described incidents of sexual misconduct by Anderson.” The acts took place as far back as the 1970s, and even until the 1990s.

Victims may bring claims even though the abuse occurred many years ago. In 2018 Michigan passed a law that extends the time period for victims of sexual assault and abuse to bring legal claims.

      FAQ

Victims of sexual assault and abuse can sue for money damages, such as money for pain and suffering, medical expenses, and lost wages.

Maybe. If your case is not settled prior to filing a lawsuit, you likely will have to testify in the lawsuit. If you hire our law firm, we will do everything reasonably possible to prepare you for your testimony, and we will be sitting by your side during your testimony.

You can still bring a civil lawsuit for money damages. It is not necessary to report a crime to the police in order to bring a civil lawsuit for money damages.

If the plaintiff is a minor child, they will be identified in the lawsuit as “Janie Doe” or “Johnny Doe” to protect their identity. If the plaintiff is an adult, the adult plaintiff will most likely have to use their full and real name in all court proceedings.
