    The Wrongful Death Act sets forth the types of damages that each survivor may recover. For example, a surviving spouse may recover damages for mental pain and suffering, loss of support and services, medical and funeral expenses, and the present value of the deceased’s future earnings (which is often referred to as “net accumulations”). All survivors may recover damages for loss of support and services. This can include monetary support and services (such as a household task) that the survivors will have to pay for in the future as a result of the deceased’s death. A minor child (which is defined by the Act as someone under the age of 25) can recover damages for lost parental companionship, instruction and guidance (which is similar to pain and suffering), but an adult child (i.e., someone over the age of 25) can only recover such damages if the deceased does not have a surviving spouse. Child survivors of all ages can recover loss of support and services. The deceased’s estate can also recover damages such as medical and funeral expenses.
