For example, we recently represented an adult children who lost their mother in a horrific accident, when a large metal plate fell from a truck, entered the windshield of her car where she was sitting as the passenger, and struck her in the head. The truck driver never stopped, and never came forward, even though the case was widely reported in the news. We investigated the case, identified the trucking company, the company that hired the trucking company to transport the metal, and the company that loaded the metal on the truck. Two of the defendants settled, but one failed to pay their fair and reasonable share, so we went to trial on behalf of our clients. After a 10-day jury trial Marc Wites obtained a $7,000,000 jury verdict for the family.
It is important that your wrongful death attorney believes in you and your case, and is willing to fight for you for as long as it takes to obtain the justice you deserve.
In a recent case, Marc Wites represented a young child who lost her father in a horrific accident in which the father was crushed by a truck. The child’s mother testified in deposition that when she and the father visited the company where the truck was located that the company had given the father permission to be on the property. A police officer and another witness gave the same testimony, but the defendant company denied that it had ever made such statements or given such permission. Marc took the case to trial, and after a multi-day jury trial, obtained a $15,000,000 jury verdict for the young child.
Wrongful death cases are among the most difficult of lawsuits, and not for reasons that you might think. The cases are hard because they involve the most tragic of events that cause the most harm to the survivors left behind.
For this reason, it is important that you hire a lawyer that is compassionate, dedicated, and will fight for your family as if they are fighting for themselves. At the Wites Law Firm, we are committed to doing everything reasonably possible to help our clients. If we shed a tear during the course of a case, or at trial in front of the jury, they are not crocodile tears, but instead real emotion that stems from the relationships we build with our clients. We are fortunate that we continue to maintain relationships with our clients long after their cases are over because of the trust and commitment we build and maintain with the individuals and families that we have been honored to represent.
Legal issues should be addressed in a timely manner. Our attorneys are ready to discuss a wide range of topics.

No. We handle personal injury cases on a contingency fee basis, which means you do not have to pay us any attorney’s fees or costs unless we obtain a recovery for you.
The Wrongful Death Act also sets forth the types of damages that each survivor may recover. For example, a surviving spouse may recover damages for mental pain and suffering, loss of support and services, medical and funeral expenses, and the present value of the deceased’s future earnings (which is often referred to as “net accumulations”). All survivors may recover damages for loss of support and services. This can include monetary support and services (such as a household task) that the survivors will have to pay for in the future as a result of the deceased’s death. A minor child (which is defined by the Act as someone under the age of 25) can recover damages for lost parental companionship, instruction and guidance (which is similar to pain and suffering), but an adult child (i.e., someone over the age of 25) can only recover such damages if the deceased does not have a surviving spouse. Child survivors of all ages can recover loss of support and services. The deceased’s estate can also recover damages such as medical and funeral expenses. Marc: Congratulations on the School Board settlement! Glad you were about to get a good result for your clients. Having been your adversary early on in the case, I can say it was a long battle and the great result was due to your persistence and creative approach to the litigation. Well done!Josh Eggnatz
